Harini Calamur makes an interesting point. I agree. If government hangs on after this, whatever the outcome, it’s just awkward.

Needless to say, not many believe these ministers or spokespeople. Their credibility has been shot to bits. The UPA’s biggest asset vis-a-vis the middle class, Prime Minister Manmohan Singh, has also been tarnished by this fallout. To add to this, the Congress has reverted to fratricidal infighting. Digvijay Singh is openly taking pot-shots at Cabinet ministers. And, as if that was not enough, UPA chairperson Sonia Gandhi, the force that binds the party and the government, has been ailing and is currently abroad for treatment. With the allies angry and the Congress flaying about like a fish out of water, it has been like a watching a train wreck in slow motion.

    Part One
    The debate on who comes first in the list of components that formed the basic structure of this Nation.1

    Ever since India achieved freedom in 1947, probably for the first time in last 64 years of independence, today again we are on the verge of undergoing a great revolution. We earned freedom after a long battle and great scarifies to evolve ourselves as a “Modern Nation”. We chose democracy to be a system of governance to our Nation. We made a constitution, set of fundamental principles or established precedents according to which our Nation would be governed. We accepted “Parliamentary Democracy” where parliament became the supreme law making authority. And the Government of the day including all its functionaries became the Executives i.e. the Administrative Authority. The Judiciary, the third pillar of the democracy became the body that interprets the law and differentiates between right and wrong in accordance with the law.

    Under the constitution all the three pillars of the “Democratic Nation” of India, were kept independent to each other. But as we all know, despite the fact that the three pillars were kept independent to each other, the executives could almost always managed to polarise the ultimate and the supreme power with them and became the true power centers in this country. The party that formed the Government, most of the time technically also ruled the parliament. They could amend even the constitution and could always successfully make the law that they desired. The power of appointing the judges of the co called independent judiciary indirectly was always with the Government. There were occasions when we saw judiciary giving historical judgments. There were also few occasions when we saw government failing in passing their own bills from the parliament. However these were only rarest rare occasions. Therefore most of the time, the Government of the day has been the absolute Power Center. At the time of independence the political leaders of this country were worshiped, if not like Gods then at least next to God. Nobody ever questioned neither them nor their integrity, and for a long long time most of them utilized this opportunity to enjoy the Authorities and the Powers as Gods, attained undue wealth and prosperity. They could always act as they wished.

    Slowly and gradually, as India started being literate, as the media reached to their drawing-rooms, the air of globalization started opening their insights, the educated class (which was unfortunately the elite class) started realizing the hidden truth behind the system of governance that was practiced in this country in the name of Democracy. However either this section was a proportionate beneficiary of the power and authority of the people in power or the section was so thin that for a long long time it could only remain a helpless spectators.

    Only recently the larger section of the society has started realizing the fact that since independence they have been always taken for an undue ride and were always being exploited by the “People in Power”, and more so in the name of democracy and sacredness of constitution. Even after being questioned they could always manage to save and sustain their power by interpreting the “basic fundamentals of this so called democracy” in the manner that always suited them. Time and again we have heard them saying, the constitution of India is above all (which they amended 94 times since it came in force), the Parliament is supreme, and the elected government has supreme authority and ultimate power to do this and that etc. etc. And the tragedy is there is no transparent and direct way we can decide who is supreme and who comes first and who is next to it. Therefore they could always interpret everything the way it suited them.
    The time has come where are ready for the next phase of political revolution. And this revolution can never be successful unless the citizens of this country realized the truth that how they were taken for a ride by their political leaders in the name of democracy and also what are their rights and duties as a citizen and also where do they stand in the priority and supremacy list of the components that formed the basic structure of this Nation, without which no democracy can ever survive in its truest form. No revolution can ever reach its logical conclusion unless it is backed by a clear unbiased and firm ideology and complete awareness about it.

    So let us start with the awareness. I will list the components that formed the basic structure of this Nation in their supremacy order. Unless we do that we will never be in a position to debate on the rights and duties of these various components. But before I start listing the components I will cite the PREAMBLE of the constitution.

    WE, THE PEOPLE OF INDIA, having solemnly resolved to constitute India into a SOVEREIGN SOCIALIST SECULAR DEMOCRATIC REPUBLIC and to secure to all its citizens:
    JUSTICE, social, economic and political;
    LIBERTY of thought, expression, belief, faith and worship;
    EQUALITY of status and of opportunity;
    and to promote among them all
    FRATERNITY assuring the dignity of the individual and the unity and integrity of the Nation;

    Do I need to say who comes first in the list? “The People” and no one else.

    Let us make the list.
    (1) The People, the Citizen and their rights
    (2) The Nation
    (3) The Constitution
    (4) {a}The Parliament {b}Judiciary {c} Executives
    (5) The Media
    (6) {a}The Elected Representatives on oath till they protect and respect the spirit & dignity of the oath that they have taken while being admitted to the Parliament. {b}The member of Judiciary on oath till they protect and respect the spirit & dignity of the oath that they have taken {c} The member of Executives on oath till they protect and respect the spirit & dignity of the oath that they have taken.

    Part Two

    The debate on who comes first in the list of components that formed the basic structure of this Nation.2

    Let us begin the debate of who comes first in the list of components that formed the basic structure of this Nation. The PREAMBLE of the constitution begins with “WE, THE PEOPLE OF INDIA, having solemnly resolved to constitute India into a SOVEREIGN SOCIALIST SECULAR DEMOCRATIC REPUBLIC and to secure to all its citizens…………”

    It says the People of this country comes first, it’s the people who solemnly resolved to constitute India into what it would be. It’s alright that it was done through their representatives but the constitution never even said “WE, THE PEOPLE OF INDIA through our representatives, having solemnly resolved to constitute India into….”. So it’s irrelevant how it was done.
    Hence the PEOPLE of this country come first in the supremacy order of the list of components that formed the basic structure of this Nation. Those who cite and talk of Constitution must read the PREAMBLE first.

    The second comes the Nation. It’s the People who decided what and how their nation would be? The people choose the path, direction and structure of their Nation. So the People are above the Nation, if they feel and realize at a point of time that the path, direction and structure that their ancestors chose, has become irrelevant they have right to differ and choose a new path, direction and structure for themselves. They always have a right to decide what is wrong and what is right for them. The ideology, the thinking, the values, the life-style, the cultural values etc etc that are fundamentals of the Nation always keeps changing and if the very fundamental of the Nation is not static how can the doctrines on which the Nation is formed would remain static. If you are not ready and willing to update and modify the doctrines on which your nation is formed you will vanish.

    The third comes the Constitution, the “written doctrines” of the Nation based on which the nation is formed. Now question arises whether (1) once formed, does a constitution becomes perfect, untouchable and final? (2) Is the constitution above its People and the very Nation? (3) Can you suppress the voice of people by citing a particular article of the constitution, forgetting the PREAMBLE and fact that all rights are reserved with its people and not with the very constitution?

    If “once formed” the constitution was like the Bible, Quran or Bhagwat Geeta and so perfect, untouchable and final, it could not have been amended for 94 times since it came in force. The only difference is the power of amending the constitution lies with the elected representatives of the People, but does that mean that this power is not with the people who elected these representatives, who these representatives represent? Does that mean, once elected these Representatives can become SUPREME, even above its people who elected them and also the Nation and the very constitution? NO Nothing can ever change the Supremacy of the People.

    Time and again the history has proved that nothing can change the supremacy of the people, no one can take away the right of the people to choose what and how their nation would be, to choose the path, direction and structure of their Nation, the right to re-constitute even their constitution.

    People even have right to discard the entire constitution and re-write a new one if and when they feel it has become irrelevant. So many other democratic nations in the world have done so. I am not saying there is anything wrong with our constitution and we must also do so, I am only talking about the supremacy of the people in a Nation.

    The fourth one is {a}The Parliament {b}Judiciary {c} Executives the three so called fundamental pillars of the democratic India. Each of these is formed by their members, authorities and office-bearers and we will discuss about them when we discuss the 6th component.

    The fifth one is Media. As a principle it has always been said that the Parliament is nothing but the voice of its people, but recent history has proved that most of the time when parliament fails to represent the voice of its people Media becomes the true voice of its people. A free but self-disciplined media is sign of a healthy democracy.

    The last one is {a}The Elected Representatives on oath till they protect and respect the spirit & dignity of the oath that they have taken while being admitted to the Parliament. {b}The member of Judiciary oath till they protect and respect the spirit & dignity of the oath that they have taken {c} The member of Executives on oath till they protect and respect the spirit & dignity of the oath that they have taken.

    Part Three

    The debate on who comes first in the list of components that formed the basic structure of this Nation.3
    Before we understand the status of our elected representatives in this priority list we have to try to find answers of few basic questions.
    (1) Does our elected representatives are only bound to remain our representatives until they are actually elected and until they take oath in parliament? And once they are elected and they are on oath they become our rulers? Do our voices remain their command only until they are elected and until they take oath in parliament? And once they are elected and are on oath it becomes opposite, their voices become our command?
    (2) Does once elected these Representatives are authorized to become SUPREME, even above its people who elected them and also the Nation and the very constitution?
    (3) Do they morally still posses the right and authority to act and do as they wish until the next election, even if they do not truly represent their people from the very next day they take oath?

    The most unfortunate part of this questionnaire is – The answer to each of these above Questions is a big NO, they never have right and authority to ever become supreme and above its people, even after they are elected and become Member of Parliament. They are elected to represent us, become our voices and not to become our rulers till they are in office.

    However the fact is once elected they have always tuned out to be our rulers and treated us as their subjects. The politicians in this country have always taken its people for ride and have always used parliamentary democracy and elections to gain power and authority and to use this power and authority to fulfill their own personal motives and to their own benefits, prosperity and happiness. They all together made a cartel and used parliament as a medium to protect them from any accountability and answerability. They fight elections against each other but when their intentions, authority and power comes under any questionability and attack, in no time they all unite together and protect themselves monopolistically. If anyone ever questions their integrity they always claim they are elected representatives of the masses and they have rights under the constitution to act as they wish. They cannot be questioned and they are not bound to answer. They have systematically deprived us from our basic fundamental rights with a plan and always safeguarded the powers from going in to our hands.

    The only so called power that remained and was left out in the hands of the people of this country was the power to elect their representatives. However the politicians of this country always knew the art of exploiting people to win elections to their own advantages. They always won elections and people always lost. The moment people voted them in, they always voted people out. They turned parliament in to a protected FORT for themselves. Once elected, they always took shelter and defended and safeguarded themselves in this protected FORT of parliament, where nobody could even touch them and being there they were only answerable to each other. The parliament became wrestling ground of its own members and citizen became only helpless distant spectators. In last 64 years of independence, the only meaning of democracy to us has been to have a chance to vote, elect or re-elect our so called representatives whenever there is an election. That’s all, nothing more. (However we will discuss this issue later if we really could ever use this power to our actual welfare and benefit.)

    Whereas they always had undisputed, unchallenged, sole and exclusive power and authority to make laws and to rule us without any answerability and accountability and they always made sure that they always remain above every law. They always made sure that NO law could ever bind them and stop them doing what they wished. This is the burning example of the fact of what can happen if the people in power and authority to rule and make laws are also being trusted and given exclusive and monopolistic power to make laws of their own accountability and answerability. This is the best example of a justice where accused himself becomes Judge.

    Now how and why could they always be successful in taking us all for rides? For four simple reasons; Because of

    (1) Inappropriate, imperfect, faulty, misleading and ambiguous laws.
    (2) Centralization of power to rule, to make laws, to appoint judges and member of other institutions like election commission and planning commission etc in the hands of politicians and party in the government and in the hands of elected representatives
    (3) Absence of any authentic and systematic accountability of the government and people in active politics
    (4) Lack of awareness and insight in the citizens.

    We can be proud and happy in saying we have power to elect them. But let us take a contrary view. Do we really elect them or they are always successful in making us elect them? They are seasoned wizards of their profession. They know the art of fooling us and winning elections. We all know, they only come back to us to gain power and later only to use the same power against us, but we always still vote them in, that speaks the level and volume of their smartness, cleverness and shrewdness. They always succeed in inventing innovative tricks to win elections. They could always divide us and rule on us. The laws are so much faulty that they won elections even if they got only 10% of the total vote of a constituency. The law is so much faulty that they could contest and win election even if they have a list of criminal charges against them. The law is so much faulty that they could contest and win election even if they are corrupt and do not perform for all their lives.

    Right in front of our eyes, they always divide us and ruled on us; however they always unite together when and defend themselves when there is any movement to make them accountable, answerable and creditable. They always unite together whenever there is an attack on their special and VIP status, whenever there is a proposal to increase and add something to their special privileges. We have read in the books they are public servants, however once elected they make us all serve them.

    We need a reformed system where our elected representatives, cannot cross the thin line of being our representatives and voices, where they can never gain power and authority to fulfill their own personal motives and where they are constantly answerable to its people.

    What remedies should be taken immediately……

    (1) Creating awareness and educating people about the above facts.
    (2) Election reforms.
    (3) Making laws that actually make our representatives public servants and makes them really accountable, answerable and creditable.
    (4) Improving the laws and blocking their loopholes of de-centralization and separation of powers to rule, from power to make laws, appoint judges and member of other institutions like election commission and planning commission etc in the hands of the people who attain authority to rule us.
    (5) Right to seek referendum on the core issues of the Nation.
    The greatest (but that doesn’t mean the only) election reform would be adding an option of “None of the above” in our ballet paper. And in case “None of the above” wins the election, the people who didn’t get even 25% of the votes of the winner are disqualified from contesting elections for six years and election is re-held. And upon re-holding the election if people who are re-contesting the elections didn’t get even 50% of the votes of the winner are also disqualified from contesting elections for six years.
    The above is only a suggestion; this is obviously open for a healthy debate.
